What is property decoupling in Singapore?

Decoupling is a legal transaction where one co-owner of a private residential property transfers (sells or gifts) their ownership share to the other co-owner. Once the transfer is completed, the transferring party no longer owns a residential property, so a later purchase may be assessed for Additional Buyer's Stamp Duty (ABSD) at the first-property rate instead of the second-property rate. The ABSD difference depends on the buyer's residency and the purchase price, and IRAS may disregard arrangements made to avoid stamp duty (see the Section 33A question below). Seek legal advice.

Can HDB flat owners decouple?

No. Since 2016, HDB no longer permits the transfer of flat ownership between spouses or family members except under specific non-commercial grounds such as divorce, death of an owner, or marriage dissolution. Decoupling is strictly applicable to private residential properties and Executive Condominiums (ECs) that have passed their 5-year Minimum Occupation Period (MOP).

What stamp duties and costs are incurred when decoupling?

Decoupling incurs: (1) Buyer's Stamp Duty (BSD) on the market value of the transferred share based on prevailing IRAS tiers; (2) Conveyancing legal fees, which this calculator estimates at about S$5,000 (actual quotes vary by law firm); (3) Bank loan restructuring or refinancing fees, estimated at about S$2,000 (actual fees vary by bank); and (4) ABSD on the transfer only if the receiving spouse already owns another residential property. The CPF refund is shown separately because it is not a cost: it returns to the transferring owner's own CPF, but it does need to be funded at transfer.

Do I have to refund CPF when decoupling my share?

Generally yes. Under CPF Board rules, a transferring party who used CPF on the property has to refund the CPF-OA savings used, plus accrued interest, to their own CPF account. This is not a cost because the money goes back to the transferring owner, but it must be funded at transfer, usually from the receiving party's payment or loan. Confirm the exact refund amount with CPF Board and your lawyer.

What is IRAS's stance on artificial 99-1 property holding and decoupling?

Under Section 33A of the Stamp Duties Act, IRAS possesses statutory powers to disregard any artificial, contrived, or non-commercial arrangement structured to avoid or reduce stamp duty. Where an arrangement (such as an artificial 99-to-1 share split executed without commercial justification) is disregarded, IRAS will claw back the full 20% ABSD avoided and impose a statutory 50% penalty surcharge. Legitimate decoupling must be a genuine, arm's-length part-purchase at prevailing market valuation with authentic bank financing. Seek independent conveyancing legal advice before undertaking any share restructuring.
